2. USER REPRESENTATIONS AND CONDUCT

5. BOOKINGS, PAYMENTS AND REFUNDS

Bookings: All tour bookings are subject to availability and confirmation. You must provide accurate information.
Payments: Full payment may be required to confirm your booking. We accept payment methods as displayed on our booking platform.
Cancellations and Refunds: Our specific cancellation and refund policy will be detailed during the booking process and on relevant service pages. Please review these carefully, as terms may vary per tour.

6. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

Services "As Is": Our Services and all Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
Your Responsibility: Your participation in any tour or activity is at your own risk. You are responsible for ensuring you are in suitable health for the activity and for complying with all safety instructions.
Limitation of Liability: To the fullest extent permitted by law, Vespa Adventures, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Services or participation in our tours, including but not limited to personal injury, property damage, or loss of data. Our total liability to you for any claim shall not exceed the total amount you paid to us for the specific service giving rise to the claim.

7. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Vespa Adventures and its affiliates from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party rights.

8. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of Vietnam. Any dispute arising from or relating to these Terms or your use of the Services shall first be attempted to be resolved through informal negotiation. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the competent courts of Vietnam.

9. PRIVACY

Your privacy is important to us. Our collection and use of your personal information is governed by our separate Privacy Policy, which is incorporated by reference into these Terms.

10. GENERAL PROVISIONS

Entire Agreement: These Terms constitute the entire agreement between you and Vespa Adventures.
Severability: If any provision is found invalid or unenforceable, the remaining provisions will remain in full effect.
Force Majeure: We are not liable for failure to perform due to causes beyond our reasonable control.
